TERMS OF SERVICE

General

  1. I, the artist, am willing to draw any subject matter expect NSFW. Subject matters relating to Ecchi and Mecha can be discussed.

  2. The artist reserves the rights to the deliverables, such as posting WIPs/finished product of it on social media, and including it on their portfolio.

  3. It is prohibited to use any part of the deliverables for non-fungible tokens (NFT), cryptocurrency, and generating derivative works using AI software and generators.

Violating any of the terms entails that the artist retains the right to terminate the commission and blacklist you, the client, associated with the commission.
**By commissioning the artist, the client agrees that the service is non-refundable.

Process

  1. Payment will be through Paypal (USD). A deposit is required upon completion of the commission request and is applied towards the service.

  2. Screenshots of work in progress will be provided for revisions and updates.

  3. Additional charges (up to $100) will be required if there's major changes during the process.

  4. After completion of service, a high resolution PNG and the original PSD file is sent.

Confidentiality

Any information and materials supplied by the client shall not be disclosed to the public without the client's prior written permission (personal, technical, marketing plans, sensitive business information, etc.).

Licenses

Standard (BASE)

  • Promotional use on social media and streaming platforms.

  • Client may not transfer or re-sell deliverables.

  • __ Extensive modifications__ performed by the client or an external party is __ prohibited__ unless given written permission.

  • Deliverables are retained as the intellectual property of Rose Ember.

Commercial (BASE x 50%-200%)

  • Promotional use on social media and streaming platforms.

  • Client retains the right of producing digital and physical merchandise of deliverables.

  • __ Extensive modifications__ performed by the client or an external party is __ prohibited__ unless given written permission.

  • Deliverables are retained as the intellectual property of Rose Ember.
